Enhanced Qualified Electronic Signature: New Rules

In 2021 and 2022, amendments to the Federal Law No. 63-ФЗ "On Electronic Signature" come into force, gradually changing the rules for obtaining and using an electronic digital signature.

In order to obtain an EDS this year, the head of the organization, individual entrepreneur or employee must contact any Certification Center (CA) accredited in accordance with 63-ФЗ.

From next year, managers, individual entrepreneurs and notaries can apply for a Qualified Electronic Signature only to the Federal Tax Service, or to a tax trustee. Trustees of the tax authorities will be Certification Centers that have received re-accreditation.

If at the time of 2022 you have a valid digital signature in your hands, you do not need to urgently apply for its replacement. You can use it until its expiration date and only then get a new one according to the new rules.

In order to obtain a Qualified Electronic Signature at the tax office, you will need to submit an application in person at the tax office or electronically in your personal account on the tax website. Then you need to find a carrier (token), on which the tax office will subsequently register you a Qualified Electronic Signature.

To obtain a Qualified Electronic Signature at the Federal Tax Service, you must appear in person. This is a Federal Tax Service requirement. This rule was not introduced by chance, it is necessary to appear in person in order for the Federal Tax Service employees to verify the identity of the recipient (clause 25 of the Order of the Federal Tax Service).

The Qualified Electronic Signature of the head is issued free of charge and in a single copy, it is reliably protected from copying.

Employees will receive a Qualified Electronic Signature at the CA. Receipt is also carried out during a personal visit. Unlike the Qualified Electronic Signature of the manager, the Qualified Electronic Signature of the employee will not be protected from copying.
