Consent to the processing of personal data must comply with the new requirements of Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications

Nowadays, it has become mandatory to have consent to the processing of personal data on the site. Such consent is taken during employment, when visiting various sites, stores and in other situations.

What is PD processing? These are all actions that can be performed with data, namely: collection, accumulation, storage, destruction, distribution, etc.

PD processing is prohibited without the consent of the subject. This threatens with disciplinary, administrative, civil, and in some cases even criminal liability.

This means that before requesting our data, the operator (for example, the owner of the site) must obtain our consent. Consent may be obtained in any form, except in cases where it is expressly provided by law that it must be in writing.

There is no approved consent form, but Roskomnadzor has published requirements for the content of consent to PD processing.

According to these requirements, consent to the processing of PD must necessarily contain a certain list of information. For example:

• full name of the PD subject;
• Contact Information;
• purpose of PD processing;
• duration of consent and more.

These requirements are valid only for a certain period, namely until September 1, 2027.

It should be noted that cases of illegal use of personal data of citizens have become more frequent. Operators often distribute citizens' data for their own commercial purposes, which, of course, leads to at least inconvenience to citizens, and at the most causes material damage. 

On March 1, 2021, Law No. 519-ФЗ dated December 30, 2020 came into force, according to which citizens have the opportunity to manage the dissemination of personal data.

In connection with all of the above, we can conclude that the legislator is trying to take all possible measures in order to secure the personal data of citizens and prevent negative consequences from their misuse. PD operators can only bring all documents in line with the latest requirements of the law, as well as try in every possible way to keep PD safe.
